Abstract
Ustavni sud Republike Hrvatske ima ključnu ulogu u očuvanju ustavnosti, zakonitosti i zaštiti ljudskih prava, djelujući kao vrhovno tijelo za tumačenje i primjenu ustavnih načela. Njegova nadležnost obuhvaća ocjenu ustavnosti zakona i podzakonskih akata, zaštitu prava građana putem ustavnih tužbi te nadzor nad izborima i referendumima. U radu je istražena doktorina ustavnog identiteta i njezin značaj u osiguravanju usklađenosti nacionalnog zakonodavstva s temeljnim vrijednostima Ustava,... More posebice u kontekstu rastućeg utjecaja europskog pravnog poretka. Poseban naglasak stavljen je na povezanost Ustavnog suda s Europskim sudom za ljudska prava i Sudom Europske unije, kao i na izazove koji proizlaze iz njihove suradnje, poput potencijalne kolizije između nacionalnog ustavnog prava i prava Europske unije. Osim analize pravnog okvira, u radu se osvrće na praktične aspekte djelovanja Ustavnog suda uključujući njegovo sudjelovanje u političkom životu zemlje kroz rješavanje sukoba nadležnosti i politički osjetljivih pitanja. Razmatrano je i pitanje samoograničenja Ustavnog suda kako bi se očuvala njegova nepristranost i izbjegla politizacija. Zaključeno je da je Ustavni sud ključan za očuvanje ravnoteže između prava pojedinca i općih interesa društva te kao korektivni mehanizam pravnog sustava. Njegova uloga zahtijeva stalnu prilagodbu suvremenim izazovima uključujući globalizaciju, pravnu kompleksnost i rastuću ulogu međunarodnog prava. Time je istican značaj Ustavnog suda ne samo za očuvanje nacionalnog ustavnog poretka, već i za usklađivanje Hrvatske s europskim pravnim standardima, čime doprinosi jačanju vladavine prava i demokratskog uređenja. Abstract (english)
The Constitutional Court of the Republic of Croatia has a key role in preserving constitutionality, legality and protection of human rights, acting as the supreme body for the interpretation and application of constitutional principles. Its jurisdiction includes the evaluation of the constitutionality of laws and by-laws, the protection of citizens' rights through constitutional lawsuits, and the supervision of elections and referendums. More constitutional identity and its importance in ensuring the compliance of national legislation with the fundamental values of the Constitution, especially in the context of the growing influence of the European legal order. Special emphasis is placed on the connection of the Constitutional Court with the European Court of Human Rights and the Court of the European Union, as well as on the challenges arising from their cooperation, such as the potential collision between national constitutional law and European Union law. In addition to the analysis of the legal framework, the paper looks at the practical aspects of the Constitutional Court's activities, including its participation in the political life of the country through the resolution of jurisdictional conflicts and politically sensitive issues. The issue of self-limitation of the Constitutional Court was also discussed in order to preserve its impartiality and avoid politicization. It was concluded that the Constitutional Court is crucial for preserving the balance between individual rights and the general interests of society and as a corrective mechanism of the legal system. Its role requires constant adaptation to contemporary challenges including globalization, legal complexity and the growing role of international law. This highlights the importance of the Constitutional Court not only for the preservation of the national constitutional order, but also for harmonizing Croatia with European legal standards, thereby contributing to strengthening the rule of law and democratic organization.
