Abstract
U radu će se detaljno objasniti način kako radnik daje otkaz poslodavcu i kako poslodavac može otkazati ugovor o radu radniku. Navest će se razlozi koji mogu dovesti do otkazivanja ugovora o radu i koji se smatraju opravdanim za otkazivanje ugovora. Uz sve navedeno spomenut će se i razlozi koji dovode do prestanka ugovora o radu, a ne smatraju se otkazivanjem ugovora. Radni odnos započinje sklapanjem ugovora o radu između radnika i poslodavca. Takav ugovor završava protekom roka na koji je sklopljen ili otkazivanjem ugovora. Otkazati ugovor može radnik ili poslodavac. Radnik ne mora navoditi razloge za otkazivanje ugovora o radu, a poslodavac koji želi otkazati ugovor o radu mora navesti razloge. Redoviti otkaz ugovora može biti osobno uvjetovan, poslovno uvjetovan, uvjetovan skrivljenim ponašanjem radnika ili uvjetovan nezadovoljavanjem na probnom radu. Radnik koji odrađuje otkazni rok ima sva prava jednaka kao da obavlja redovan rad.
Abstract (english)
The paper will explain in detail how an employee gives notice to an employer and how an employer can cancel an employee's employment contract. The reasons that may lead to the cancellation of the employment contract and which are considered justified for the cancellation of the contract will be stated. In addition to all of the above, The reasons that lead to the termination of the employment contract will also be mentioned, and are not considered contract cancellation. The employment relationship begins with the conclusion of an employment contract between the employee and the employer. Such a contract ends with the expiration of the term for which it was concluded or with the cancellation of the contract. The contract can be canceled by the employee or the employer. The worker does not have to state the reasons for canceling the employment contract, and the employer who wants to cancel the employment contract must state the reasons. Regular termination of the contract can be personally conditioned, business conditioned, conditioned by the hidden behavior of the employee or conditioned by dissatisfaction during the probationary period. An employee who completes the notice period has all the same rights as if he were performing regular work.
