Abstract
Tema ovog završnog rada je zemljišnoknjižni postupak u hrvatskom pravnom poretku. U radu se objašnjava sastav zemljišne knjige te koje vrste upisa u zemljišne knjige predviđa Zakon o zemljišnim knjigama. Zatim se detaljnije opisuje sam zemljišnoknjižni postupak, narav tog postupka, temeljna načela i nadležnost za njegovo vođenje, stranke u postupku i njegovo pokretanje, ovlašteni predlagatelji za pokretanje postupka, odluke koje se donose te pravni lijekovi koji se mogu uložiti po završetku postupka. Potom su opisani posebni zemljišnoknjižni postupci, kao što su obnova i osnivanje zemljišnih knjiga te pojedinačni ispravni postupak, a na kraju rada zemljišnoknjižni postupak se prikazuje kroz primjere iz sudske prakse. Kroz analizu primjera iz sudske prakse, rad sadrži praktičnu primjenu zemljišnoknjižnog postupka i njegove specifičnosti u stvarnim situacijama. Također se razmatraju izazovi i problemi koji se javljaju u provedbi ovih postupaka, te načini njihovog rješavanja. Na kraju, rad nudi preporuke za unapređenje zemljišnoknjižnog sustava u cilju povećanja efikasnosti i pravne sigurnosti.
Abstract (english)
The topic of this final paper is the land registry procedure in the Croatian legal system. The paper explains the composition of the land register and what types of entries in the land register are provided for by the Land Register Act. Then the land registry procedure itself is described in more detail, the nature of that procedure, the basic principles and jurisdiction for its conduct, the parties to the procedure and its initiation, the authorized proponents for initiating the procedure, the decisions that are made and the legal remedies that can be applied after the procedure is completed. Then, special land registry procedures are described, such as the renewal and establishment of land registers and the individual correct procedure, and at the end of the work, the land registry procedure is presented through examples from court practice. Through the analysis of examples from court practice, the paper contains the practical application of the land registry procedure and its specificities in real situations. The challenges and problems that arise in the implementation of these procedures, as well as ways to solve them, are also considered. Finally, the paper offers recommendations for improving the land registry system in order to increase efficiency and legal certainty.
